Worker’s Compensation: What It is, How it works, and Who Pay

Being an Employer, it is a legal responsibility to take care of and being responsible to the security and safety of the workplace. But accidents are quite common to happen. Worker compensation insurance takes action in this place and provides coverage.

Assurance on medical care and need will be covered under this insurance policy. Along with compensation to the financial loses of the injured worker due to holding the expenses for medical needs. So, if the worker is injured while he/she was working, it helps employers from avoiding lawsuits by workers and yet compensating the worker for their loses or harms that they’re gone through.

In the work premises or anywhere, if the employer is injured being at the act of ‘course and scope’ of his employment then it will be under the coverage of this workers compensation insurance, only if the employer has the workers comp.

Let’s take a good example of workers comp, death claims in any accidents, this mainly occurs when the worker is coming for work purpose. It can be a trip made in company’s car or employees’ own vehicle. The accidents while driving to and from work, these are not covered under this insurance.

Along with the accidents, workers comp can cover the injuries that the worker may have sustained while working. It could be workplace violence, terrorist attacks, maybe some unfortunate events or can be a natural disaster.

While working with dangerous materials like toxic chemicals, waste materials, there is always some risks of illness and occupational diseases. Employers deal with it by making a contract with workers that will be covered by workers compensation insurance. Maybe it can be exposure to toxic chemicals, or any other toxicity or harm, it will be covered.

Treatments received:

All the medical necessity and appropriate treatment for recovering the injured worker, will be supplied. The medical cost is soaring in states, have manifested measures to avoid these miss fortunate events more and more. There are much more improved management, guidelines, on things like protocol, centre events and charts and awareness camps. Even doctors make the diagnostic tests regularly if there is a specific injury for any worker.

The insurance can cover income replacement based on the disability or partial disability of the worker, depending it is permanent or temporary. Though the impairment is a reduction in earning capacity.

Do you really need Workers Compensation Insurance?

Depending on your state, many states actually made it free for the employers on this mandatory coverage laws if there is only few employees. Though the threshold will vary. This mandatory threshold number of employees maybe like 3,4 or 5. But, we should be recommending you to think about your employee’s security. In some states, workers compound insurance can be optional too like Texas.

It is also in the possibilities that in some states, the family members of the business owner like parent, children, spouse, etc who work for the business, doesn’t counted as an employee under the insurance scheme. So, these exceptions do not apply on members of one family, e.g., sister, brothers-in-law etc.

Interestingly, under some laws contractors who work independently, may not be considered as employees. However, workers compensation insurance is applicable if the contractor works under you. Then the subcontractor will be treated as your employee and will be insured. That makes you liable for any injury on the uninsured subcontractor as your employee.

So, please don’t take any risks and unintended liabilities. Even large companies when requiring to hire a contractor, every subcontractor, for taking providing proof they also make workers comp insurance for handling the risky circumstances.

Regardless of how many employees you have or either the insurance is required or no, the harms done on any injured worker while doing your course of work for you, makes you legally liable.

Even one claim of seriously injured employee can bankrupt small business. And being responsible for not letting any misfortunate event to being happened, is taking precautions. Yes!! Taking workers compensation insurance is a precautionary step forward. Though the payable premium amount for workers compensation insurance is also needed to be dealt with.

Who sells Workers Compensation Insurance?

The Businessowners’ Policy (BOP) that you hold doesn’t make it part of workers compensation insurance. It should be purchased like any other separate insurance policy.

As we stated earlier each state has their own rule about making this insurance mandatory for every employer to take for keeping their workers in mind. Few states make all employers to buy the insurance from state fund. So, weather you buy the insurance from state fund or a private insurer, make sure to clear the process properly.
